You agree to resolve disputes through individual arbitration instead of court and waive rights to participate in class-action lawsuits or similar group actions.
Mandatory arbitrationClass-action waiver
Why it matters: This limits your ability to sue COGNOSPHERE in court or participate in class-action lawsuits, requiring individual arbitration for most disputes. You have a time-limited right to opt out.
EXCEPT FOR CERTAIN TYPES OF DISPUTES SPECIFICALLY DESCRIBED IN THOSE SECTIONS, YOU AND COGNOSPHERE AGREE TO RESOLVE DISPUTES BY BINDING, INDIVIDUAL ARBITRATION. ARBITRATION PRECLUDES YOU FROM SUING IN COURT OR HAVING A JURY TRIAL. YOU AND COGNOSPHERE FURTHER WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS-ACTION LAWSUIT OR CLASS-WIDE OR REPRESENTATIVE-TYPE ARBITRATION OR TO PURSUE QUI TAM-TYPE CLAIMS OR CLAIMS IN A CLASS, GROUP OR REPRESENTATIVE CAPACITY OR AS A PRIVATE ATTORNEY GENERAL OR AS A THIRD PARTY. YOU HAVE A TIME-LIMITED RIGHT TO OPT OUT OF THE ARBITRATION AGREEMENT, AS EXPLAINED IN SECTIONS 20 AND 21 BELOW.
